Regular Meeting and Public Hearing

Chairperson Sue Forder called the Regular Meeting to order at 7:00PM, at the Yates Town Hall, 8 South Main Street, Lyndonville, New York 14098.

Paul Lauze, ZBA Member

MINUTES:

 

Chairperson Sue Forder questioned Dan Wolfe on Kenneth Martins Variance.

 

Dan Wolfe – He’s met set back requirements for pole barn and now wants to convert to a business.

 

Mr. Martin is asking for a 55’ variance from right of way.

            Storage and Parking were discussed.

 

At 7:20 pm Paul Lauze excused himself to go and see if Kenneth Martin could appear to answer questions.

 

Meeting was adjourned for the public hearing.

The following notice was placed in the Medina Journal Register on March 28, 2011.

 

PLEASE TAKE NOTICE; there will be a Public Hearing held on April 7, 2011 at 7:30 pm at the Yates Town Hall, 8 South Main Street, Lyndonville, New York 14098.  The purpose of the public hearing is for an Area Variance, Application # 01-11, submitted by Kenneth Martin at 11942 Alps Rd. Lyndonville, New York 14098 for a 55 ft Front Variance measured from the Right of Way.  This application may be reviewed at the Office of the Town Clerk, 8 South Main Street, Lyndonville, NY 14098 during regular business hours.

 

All persons wishing to be heard shall be heard at this time.  Correspondence may be made in person at the Public Hearing or by letter to the Town of Yates Zoning Board of Appeals.

 

Chairperson Sue Forder asked Kenneth Martin where the parking would be.

 

Kenneth explained that he was going to put the sheds by the road and the customer would pick them up.

 

Chairperson Sue Forder also asked how often will the sheds be picked up.

 

Kenneth said once a week.

 

Dan Wolfe asked what kind of truck will be picking the sheds up.

 

Kenneth – a pickup truck with a trailer.

 

Donna Bane asked where are the sheds being stored.

 

Kenneth – inside unless he needs room, then outside.

 

The Board is concerned with the storage of the sheds.  The Board would like to see the sheds moved to the other side of the building.

 

Dan Wolfe suggested to have the customer pick up the sheds as they get done.

 

Chairperson Sue Forder asked if Kenneth could put the sheds on the south side instead of the north side of the building.

 

Kenneth – smaller sheds yes but the bigger ones would be harder.

 

Steve Freeman – give the variance but keep the sheds out of the front (keep them back out of public view and road)

 

Chairperson Sue Forder asked what the hours of operation are going to be.

 

Kenneth – 7:00 am – 5:00 pm or later till 7:00 pm (maybe).

 

Chairperson Sue Forder then asked if there were any more questions.

 

RESOLUTION NO. 01-11

 

RESOLUTION TO ACCEPT THE 55’ FRONT VARIANCE FROM KENNETH MARTIN AT 11942 ALPS RD. LYNDONVILLE, NEW YORK 14098 WITH THE STIPULATION THAT THERE IS TO BE NO STORAGE OR DISPLAY ON THE NORTH SIDE OF THE BUILDING.

 

RESOLVED, to accept the 55’ Variance from Kenneth Martin at 11942 Alps Rd. Lyndonville, New York 14098 with the Stipulation that there is to be no Storage or display on the North Side of the Building.
