Regular Meeting and Public Hearing

Chairperson Sue Forder called the Regular Meeting to order at 7:00PM, at the Yates Town Hall, 8 South Main Street, Lyndonville, New York 14098.

MINUTES:

 

Mr. Stauffer is asking for a 32 ft. West Side Setback Variance.

            Mr. Stauffer wants to build an addition on to the back side of his house.

 

Chairperson Sue Forder and ZBA members Donna Bane, Paul Lauze and Gary Daum went down to see the property. 

 

It was discussed that Mr. Stauffer is not coming any further to Morrison Rd. (which is to the west of the house) he is building off the back of his house (toward the north).

 

The Zoning Board thought that it was necessary for the variance because the addition didn’t meet code even though Mr. Stauffer wasn’t building any closer to the road (Morrison Rd.) than the existing house.

 

A question came up by a neighbor in regards to the public hearing notice that was published in the paper.  The notice in the paper stated, The purpose of the public hearing is for an Area Variance Application # 03-12, submitted by Benjamin Stauffer at 12115 Roosevelt Hwy., Lyndonville, New York 14098 for a 32ft. West Side (Morrison Rd.) Setback Variance.  The neighbor thought it was on the west side of Morrison Rd., which happens to be his property.  It was explained that it was the west side of the house by Morrison Rd.

 

Dawn Metty the Deputy Clerk spoke with Andrew Meier at Webster Schubel & Meier’s office in regards to how the public hearing notice was published in the paper.  Mr. Meier understood what the notice meant and said go ahead with the meeting.

 

The Area Variance Findings & Decision form was filled out.

The following notice was placed in the Medina Journal Register on March 26, 2012.

 

PLEASE TAKE NOTICE; there will be a Public Hearing held on April 3, 2012 at 7:30 pm at the Yates Town Hall, 8 South Main Street, Lyndonville, New York 14098.  The purpose of the public hearing is for an Area Variance, Application # 03-2012, submitted by Benjamin Stauffer at 12115 Roosevelt Hwy., Lyndonville, New York 14098 for a 32 ft West Side (Morrison Rd.) SetbackVariance.  This application may be reviewed at the Office of the Town Clerk, 8 South Main Street, Lyndonville, NY 14098 during regular business hours.

 

All persons wishing to be heard shall be heard at this time.  Correspondence may be made in person at the Public Hearing or by letter to the Town of Yates Zoning Board of Appeals.

 

This is Application # 03-2012 for Benjamin Stauffer requesting a 32 ft. west side setback variance to build an addition on to his house.

 

Mr. Stauffer said that his family is getting bigger and needs more room.  He wants to build a 16 x 42 addition flush with the house.

 

Chairperson Sue Forder then asked if there were any more questions.

 

ZBA member Pat O’Brien asked if the addition was a 1 or 2 story.

 

Mr. Stauffer said it was going to be a 2 story with space up stairs.

 

Another question asked was, How much footage to the north does he have?

            He has about 460 feet.

 

RESOLUTION NO. 03-2012

 

RESOLUTION TO ACCEPT THE 32 FT. WEST SIDE (MORRISON RD.) SETBACK VARIANCE FROM BENJAMIN STAUFFER AT 12115 ROOSEVELT HWY., LYNDONVILLE, NEW YORK 14098

 

RESOLVED, to accept the 32 ft. variance from Benjamin Stauffer at 12115 Roosevelt Hwy., Lyndonville, New York 14098

 

Votes:  5 Ayes (Forder, Bane, Lauze, Daum, O’Brien), 0 Nays

 

NO FURTHER BUSINESS WAS DISCUSSED
