RESOLUTION NO.101-12/09

 

RESOLUTION TO SET YEAREND MEETING

 

WHEREAS, all business needs to be finished by the end of the year in order to close the books, be it

 

RESOLVED, the Town of Yates end of the year meeting shall be Monday December 28th, 2009 at 3:00 P.M.

RESOLUTION NO. 102-12/09

 

RESOLUTION TO AUTHORIZE SUPERVISOR TO SIGN AN AGREEMENT WITH THE OFFICE OF THE AGING FOR THE NUTRI-FARE PROGRAM

 

WHEREAS, the Town of Yates has always allowed the Nutri-Fare program to use the meeting room for the dinners that they provide to person age 60 and over on Mondays, Tuesdays, and Thursdays, be it

 

RESOLVED the Supervisor is hereby authorized to sign the agreement for the 2010 calendar year.

RESOLUTION NO.103-12/09

 

RESOLUTION TO INTRODUCE LOCAL LAW NO. 1 FOR 2010

 

WHEREAS, the Zoning Officer and the Planning Board of the Town of Yates have worked together to amend the section of the Zoning that pertains to camping units.  And

 

WHEREAS a local law has been written amending the zoning section, as follows:

 

SECTION 1.   The purpose of this Local Law is to amend the Zoning Local Law of the Town of Yates as hereinafter provided.

 

SECTION 2.  Article VI, Section 625 Camping Unit/Recreational Vehicles, of the Zoning Local Law of the Town of Yates is hereby amended by revising and amending Section 625 to read as follows:

 

A.      A special permit shall be granted by the Code Enforcement Officer upon request for a single camping unit to be occupied on improved or unimproved lot, outside of approved campgrounds, for a period not to exceed a total of 30 days duration per camping season.  No fee for permit required.

 

B.      Camping season shall be between May 15 and September 30.

 

C.      For the purpose of this section, improved property shall be land (lot) upon which there is a dwelling that conforms to the articles of this Local Law and unimproved shall be land (lot) upon which there is no dwelling.

 

D.      All Camping Units are to be placed on the side or rear of improved property.  Placement of a camping unit must be in accordance with the setbacks required for buildings in the respective zone of the property.

 

E.       The camping unit must either have self-contained sanitation system or be connected to adequate sanitation facilities.

 

F.       Any recreational vehicle/camping unit occupied shall have a current valid registration allowing it to travel on the highway.

 

G.      No recreational vehicle/camping unit shall be stored on an unimproved property.  A permit is not required for an unoccupied camping unit to be stored on an improved property. 

 

Failure to comply with any of the foregoing provisions may result in a fine of not more than $250.00 or imprisonment for a period not more than six (6) months or both.  Each week a violation is continued shall be deemed a separate offense.

 

SECTION 3. 

 

(a) This local Law shall take effect immediately upon filing with the Secretary of State pursuant to the Municipal Home Rule Law.

 

(b) If any part or section of this Local Law shall be held to be invalid, the remaining provisions thereof shall not fail but shall remain in full force and effect.

 

(a)     All local laws, ordinances, rules and regulations, or parts or portions thereof that conflict or are contrary to any provision of this Local Law are hereby repealed.

 

BE IT RESOLVED, that this change shall be sent to the Orleans County Planning Board for their recommendations , and be it

FURTHER RESOLVED there will be a public hearing on this local law on January 7th 2010 at 7:00 P.M.

RESOLUTION NO. 104-12/09

 

RESOLUTION TO SIGN AGREEMENT WITH ORLEANS COUNTY FOR ANIMAL CONTRACT

 

WHEREAS, the Town already has a contract in place with Orleans County for the animal Control, be it

 

RESOLVED the Town of Yates shall renew this contract with the exception that census will be done every 3 years instead of every two years.

 

BE IT FURTHER RESOLVED,  a copy shall be attached to these minutes.

Report of Town Officers:

 

Code and Zoning have issued 60 building permits this year. Town of Yates has been busy.  I am checking on some  property maintenance issues and  issuing letters.

 

 

Assessor: have finished schooling for this year. I am taking pictures of sales records. State will be cutting ORPS money

 

Highway and Water- 6 new water hookups. Have been working on finishing Hall Road. CHIPS money should be received on December 16th.

Supervisor Martino stated there will be a Chamber meeting January 29,2010 from 11:00 a.m. until 2:00
