Regular Planning Board Meeting

May 3, 2012

 

 

Chairman Donald Lamay called the Regular Planning Board Meeting to order at 7:00 pm, at the Town of Yates, 8 S. Main Street, Lyndonville, NY 14098.

MINUTES:

 

Chairman Donald Lamay entertained a motion to accept the minutes from the April 5, 2012 meeting.

 

RESOLUTION NO.  4-5/12

 

RESOLUTION TO ACCEPT THE MEETING MINUTES FROM THE APRIL 5, 2012 MEETING AS PRESENTED TO EACH BOARD MEMBER.

 

RESOLVED, to accept the meeting minutes from April 5, 2012 as presented to each Board Member.

Cal Stinson came in to discuss the proposed Special Use Permit to operate a redemption center.

Cal would like to rent the property from Mr. Yoder.  The property is located on the corner of Millers and   Marshall Road. 

 

Dan Wolfe updated the Planning Board on Mr. Stinson’s Special Use Permit and what he would like to do.

 

With this particular piece of property it was zoned as light industrial but back in 2007 it was rezoned to agricultural/residential.  This will make it difficult for Mr. Stinson to have a business on this piece of property.

 

Dan had an idea to maybe rezone this property back to light industrial or general business.  It would take 3 months to complete.

 

Nancy Thering asked Mr. Stinson if he was going to have a permanent structure. 

                Mr. Stinson said No, it would be an accessory structure. Set on blocks.

 

Chairman Donald Lamay briefly discussed zoning dos and don’ts.

 

Gary Thering asked what 697 was in the zoning regulations book.

 

Chairman Donald Lamay briefly explained what it is and will give a copy to Mr. Thering.

 

Mr. Thering also asked what Mr. Yoder’s land can be used for.

 

Dan Wolfe – a house can be built on it.

 

Dan Wolfe asked Mr. Stinson about having the redemption center at his house.

 

Mr. Stinson said that it wasn’t an ideal situation.

 

Steve Freeman said what about permitted use in Agricultural/Residential.

 

Chairman Donald Lamay also gave the idea of maybe adding redemption center to the agricultural/residential list.

 

Chairman Donald Lamay has asked Mr. Stinson to do a formal special use permit with a good site plan and we will take it step by step.  The Board will work with him but it will take time.  The Board will also look into more information and get back to Mr. Stinson.  Chairman Donald Lamay thanked Mr. Stinson, Mr. Yoder and everyone else who was there for coming.

 

Chairman Donald Lamay then presented the Board with Harlan Stauffer’s Special Use Permit for a windmill.

 

The Board went over the description of the request, which is to erect a 92 ft. windmill to produce compressed air for farm and home use. Then discussed the zoning ordinance in sections 591.1, 591.30 and 660.

 

Mr. Stauffer was not at this meeting, the Board will present his application at next month’s meeting and hope that he will be able to make it.

 

Next – Dan Wolfe told the Board that he is going to be more proactive on camper permits this year.

 

Chairman Donald Lamay let the board know that we are still waiting for the Town Board to have the Public Hearing.  The Town Board would like to process more than one change at a time to Local Laws when, and/if more cost effective. 

 

Round Table – There was nothing from the County Planning Board, the April meeting was cancelled.
