Yates, 8 S. Main Street, Lyndonville, NY 14098.

MINUTES:
Chairman Donald Lamay entertained a motion to accept the minutes from the December 6, 2012 meeting.
RESOLUTION NO. 1-2/13
RESOLUTION TO ACCEPT THE MEETING MINUTES FROM THE DECEMBER 6, 2012 MEETING AS PRESENTED TO EACH BOARD MEMBER.
RESOLVED, to accept the meeting minutes from December 6, 2012 as presented to each Board Member.

Note – There was no January meeting due to the lack on an agenda
Daniel Auker is here on behalf of Randal Stauffer. He has submitted a special use permit for a Section 741 (waterfront area) Home Business Class B for Sheds. The property is located on 11469 Lakeshore Rd.
Chairman Donald Lamay went over the Short Environmental Assessment Form and the site plans.
Mr. Stauffer does meet all the setbacks.
Ralph Smith asked – How far from the lake shore?
Dan Wolfe – About 1,800 ft.
The sheds will be built when there is an order.
Paul Lauricella – Is there a generator running?
Daniel Auker – Diesel, only when he’s working. Can muffle the noise, if needed.
Chairman Donald Lamay entertained a motion to have a public hearing next month for Randal Stauffer.

RESOLUTION TO THE HAVE PUBLIC HEARING
RESOLVED, to have the public hearing for Randal Stauffer.

Next Chairman Donald Lamay went over the second special use permit submitted by Marlin Yoder for a Section 747 – for a dog kennel (Agricultural/Residential District)
Does meet all setbacks and the Short Environmental Assessment Form has been completed.
He has 8.95 acres. There is a 30 x 40 building and 16 x 18 of it will be used as a kennel.
Dan Wolfe let the Board know that Marlin is thinking about having twenty dogs.
A question came up about the waste. Dan Wolfe said that it shouldn’t be an issue.
The property around Marlin is all open.
A few other questions that came up are: What size dogs? (small/big)
Is he going to stack them?
Is he going to breed them?
Chairman Donald Lamay entertained a motion to hold off on the public hearing for Marlin Yoder until we have more information.

Next - Dan Wolfe let the planning board know that Warren Johnson has been cleaning up the cars around his property and is looking better. Dan Wolfe also said that he hasn’t been back to speak with Harrold Suhr regarding parking at the White Birch Golf Course but will as soon as he has a chance.
Chairman Donald Lamay will put it on the agenda for the next meeting. Chairman Donald Lamay also let the board know that Tim Zaborowski’s Archery & Gift Shop business is now closed.
Chairman Donald Lamay spoke about restaurants only being allowed in general business districts (Pg. 40 Sec. 530). Why can’t they be allowed in any other districts? Chairman Donald Lamay is going to write up a proposal to present to the Town Board, (for review at our next Planning Board meeting).
Briefly the board discussed redemption/distribution centers and possibly adding them to our Zoning Regulations Book. It may fit in Sec. 510 pg. 36. Redemption/distribution center will need a definition. There has also been an interest in storage units which currently are only allowed in General Business Districts. Are there any other areas that could be considered a General Business District?
Chairman Donald Lamay is going to send a list of those items for Stuart Brown to look at.
Chairman Donald Lamay welcomed Mark Hughes to the planning board.
Gary Daum briefly went over the County Planning Board meeting.
