MINUTES:
Chairman
Don Lamay opened the meeting by thanking Richard Kurz for filling in for him as
Chairman at the meeting December 4.2008. Next Don reviewed the minutes from the
meeting December 4.2008.

Next
the board reviewed the request from Daniel Wolfe, for adding item G (619) to
the zoning. All dwellings shall have continuous masonry footer, 42” below
grade, exception (doublewide dwelling). Dan suggested that it would be nice to
have it in the local zoning.
Kurz
added that the board would have to send a zoning referral form to county and
they would have to review it, then the Town Board Member’s would have to vote
on it.

Daum on County Level- We have set the schedule of our meetings, and that the
County passes the application for Mr. Martins Special Use Permit B with
conditions.
Gary
Daum added that the county would like to have feed back on what action has
taking place.
Next
Don reviewed the application for Samuel Martin for a Special Use Permit No.
08-37, the Board was very pleased with Mr. Martin’s corporation to change the
items that where requested of him during this process.
The
Board took a recess from their regular Planning Board Meeting to start the
Public Hearing.
Public
Hearing started at 7:20 for Mr. Samuel Martin application no. 08-37 for Special
Use Permit B for A, Metal Fabrication & Sales at 12551 Roosevelt Highway,
Lyndonville NY. 14098.

opened the Public Hearing saying that we had sent the notice out to Carlton,
the newspaper, and the neighbors. This application is for a Home Business B.
Mr. Martin was asked to complete the following from the County Planning Board.
1.
The location of off-street parking shall be depicted on the site plan
in sufficient quantity such that customers’ vehicles at time of peak demand can
be accommodated, as determined by the Yates Planning Board.
2.
The location of the free standing sign shall not obstruct the sight
lines of vehicles attempting to exit the property, in the judgment of the Yates
Planning Board.
3.
The home business shall not commence operation until all necessary
permits
have been obtained by the
applicant.
Comments:
The last condition would also include the highway access from NYSDOT. If
welding would also be conducted in the shop, the Yates Planning Board may also
want to inquire about any special fire safety precautions and the manner in
which any gases would be stored, secured, and transported.
The board discussed the county’s recommendations of the application for Special Use Permit B with conditions.
The
Board felt that Mr. Martin has satisfied all the recommendation from County and
has obtained all necessary permit and satisfied all fees involved in this
application
.

RESOLVED,
to issue a Special Use Permit for a Home Business B, Medal Fabrication and
Sales Business, Samuel Martin 12251 Roosevelt Highway, Lyndonville NY. 14098
with the following conditions:
A.
Must comply with all attached zoning regulations as outlined under Section 741 Home Business B and
section 600 signs.
The
Board will vote on the application and notify Mr. Martin about their decision.
As
there was no further business to discuss, the Public Hearing was closed at

commented that it was great working with Samuel Martin during this time.
Paul
Lauricella asked the board if Mr. Martin would be able to start the business
before his new building went up? The board members said yes, Mr. Martin has one
year to complete his new building. Mr. Lauricella said that was great, he was
looking forward to having the business in the neighborhood.
