Chairman Gary Daum called the Regular Meeting to order at 7:00 pm, at the Yates Town Hall, 8 South Main Street, Lyndonville, New York 14098.

 

Those Present:             Gary Daum, ZBA Chairman      

                                    Mike Boring, ZBA Member

                                    Pat O’Brien, ZBA Member

                                    Keith McKinney, ZBA Member

Dawn Metty, Deputy Clerk

MINUTES:

 

Chairman Gary Daum – Reviewed the Area Variance application from Lee Kassay.  He is asking for a 5’ front setback from Platten Rd., 34’ front setback from Greenman Rd. and a 10’ side setback on the east side.  Denial was made because of conflict with the Zoning Code, Section 510 Paragraph E.  (75’ front setback & 30’ side setback required)

 

Chairman Gary Daum asked if the Zoning Board had a chance to look the application over and are there any questions or concerns.

 

There is a concern/question of where the leech lines & septic will be.

 

There were no other questions or concerns from the board members.

 

Area Variance Findings and Decision sheet was filled out.

 

The board welcomed new board member Keith McKinney.

The following notice was placed in the Batavia Daily News on July 20, 2015.

 

PLEASE TAKE NOTICE; there will be a Public Hearing held on July 28, 2015 at 7:30 pm at the Yates Town Hall, 8 South Main Street, Lyndonville, New York 14098.  The purpose of the public hearing is for an Area Variance, Application # 01-15, submitted by Lee Kassay at 11869 Platten Rd., Lyndonville, New York 14098 for a 5’ front setback from Platten Rd., 34’ front setback from Greenman Rd. and a 10’ side setback on the east side.  This application may be reviewed at the Office of the Town Clerk, 8 South Main Street, Lyndonville, NY 14098 during regular business hours.

 

All persons wishing to be heard shall be heard at this time.  Correspondence may be made in person at the Public Hearing or by letter to the Town of Yates Zoning Board of Appeals.

 

Chairman Gary Daum – We received an Area Variance application from Lee Kassay requesting a 5’ front setback from Platten Rd., 34’ front setback from Greenman Rd. and a 10’ side setback on the east side.  The application has been reviewed and is complete with a site plan.

 

Chairman Gary Daum - A concern with the lot regarding the septic system was asked.  Will there be any impact on the home.

 

Lee Kassay – No.  It will be on the Platten Rd. side.  Art Hill is going to do it.  A new one will be put in.  The old one will be filled in along with the old well.  There is enough room.

 

Chairman Gary Daum – There will be a cement pad?

 

Lee Kassay – The whole thing where the house is going to be, will be cement. 

 

Keith McKinney asked where the driveway was going to come off.

 

Lee Kassay – Off of Greenman Rd. for now.

 

Keith McKinney also asked Lee if he was going to have a porch at some point.

 

Lee Kassay – Yes

 

Chairman Gary Daum asked if there were any more questions.

 

There were no more questions

 

Chairman Gary Daum made a motion to close Public Hearing.
