Whereas a public notice was published  in the official newspaper about a public hearing on the fire contract with the village. That public hearing is now open.

Sandra Lauricella- What is the possibility of plowing the cemetery? I go there a couple times a day and see other people doing the same

 

Supervisor Belson- I will check with the Highway Superintendent and the Village of Lyndonville.

 

Richard Pucher read a letter would like his name withdrawn from survey and S.O.S. divorces itself from the committee. Survey was already done by S.O.S

Does not feel another survey is necessary. Questioned sending to registered voters

 

Susan Campbell- not everyone received survey

 

Harvey Campbell-on the daily news survey you could vote more than once if you had extra e-mails

 

Anne Smith- does not feel the need to spend taxpayers money on another survey.

 

Paula Simons- daughter is still on voter registration list she lives in California.

Clerk Donald stated that Board of Elections sends out postcards to residence of voters?  Asked if  postcard was returned stating no longer lived there.

John Riggi presented letter thanking Mr. Belson for long years of service- Looks forward to working with Board Members.  Asked the Board to respect the election results and survey results and curtail all activity on the survey, immediately oppose the project.

RESOLUTION NO. 85-11/15

 

RESOLUTION TO APPROVE FIRE CONTRACT WITH THE VILLAGE OF LYNDONVILLE

 

WHEREAS, a Public Hearing was held on November 12,2015 at 7:00 P.M. and all persons requesting to be heard were heard. and

 

WHEREAS, the Village of Lyndonville has presented the Town of Yates with a five year contract for fire as per attached.

 

THIS AGREEMENT dated as of the 1st day of June, 2015, by and between the TOWN BOARD OF THE TOWN OF YATES, ORLEANS COUNTY, NEW YORK, hereinafter designated as "TOWN-, and the VILLAGE OF LYNDONVILLE, ORLEANS COUNTY, NEW YORK, hereinafter designated as "VILLAGE".

WHEREAS, there has been duly established in said Town of Yates a Fire Protection District embracing territory in the Town wholly outside of the Village of Lyndonville. Such territory is more fully described in a Resolution establishing the said district duly adopted by the Town Board of the Town of Yates on March 10, 1937, and

WHEREAS, following a public hearing duly called by the said Town Board, the Town was duly authorized to contract with the Village for fire protection to the said Fire Protection District upon terms and provisions hereinafter set forth,

NOW, THEREFORE, the Town does engage the Village to furnish fire protection to the Town of Yates Fire Protection District and the Village agrees to furnish such protection in the following manner, to wit:

 

1.       The Fire Department of the Village shall at all times, during the period of this Agreement, be subject to all calls for attendance upon any fire, emergency medical service calls, motor vehicle accidents and/or hazardous conditions occurring in the said Fire Protection District, and when so notified by alarm or telephone call from any person therein concerning a fire or above mentioned situation therein, the said fire department will respond and attend upon the fire or situation without delay, with one or more companies and such suitable trucks, pumping and hose apparatus and ladders of the Village as may be necessary. Upon arriving at the scene of the fire or situation, the firemen of the Village attending shall proceed to extinguish the fire and/or deal with the situation for the saving of life and property in connection therewith.

 

2.       In consideration of the furnishing of the said aid and use of its apparatus, as foresaid, the Village shall receive from the Town a sum, calculated as hereinafter provided, for each fiscal year of the Village during the term of this contract. One-half of the payment shall be due in February and the remaining one-half shall be due in April.

The Town covenants and agrees, on behalf of the said Fire Protection District, to pay the sum, calculated as hereinafter provided.

 

1.      The Village Clerk-Treasurer shall annually during the term of the Agreement, not later than the fifteenth (15'h) day of August, file with the Town Budget Officer the sum, calculated as hereinafter provided, for the payment due in the ensuing calendar year.

 

The sum to be paid by the Town shall be calculated as follows:

2.      The parties hereto agree to form a joint Public Safety Committee comprised of two (2) Town Board members and two (2) Village Board members. The Public Safety Committee shall be charged with the planning and review of all issues relative to fire protection and ambulance services as well as other related public safety issues. The Village Fire Company shall annually develop the fire company budget and submit a recommended fire company budget to the Public Safety Committee. The Public Safety Committee shall receive and review the budget, and make any adjustments it deems appropriate. Such budget shall then be submitted to the Village Board for its review and inclusion in the Village budget. In the event of default by the Public Safety Committee, the Village Board shall use the prior year's budget plus any increased contractuals.

 

3.      The Village shall be responsible for any and all loss or damage to fire apparatus sustained in answering such fire calls and shall be further responsible for the payment of all claims for injuries to or death of firemen in connection with the said calls in such amounts and in such manner as if the calls were duly made within the Village of Lyndonville.

 

4.      All moneys to be paid under any provision of this Agreement shall be charged upon the taxable property of the said district and collected by the Town along with the annual Town taxes.

 

5.      Per Village Resolution No. 96-52 - Fire Co. Savings Account - On motion of Marc Scarr, seconded by Steve McAvoy, that the Fire Co. Savings account (NYCLASS FIRE COMP) has been established for the purchase of equipment for the Fire Co..  This account is controlled by the Village Board and not the Fire Co..  All moneys remaining within the Fire Co. budget account after the payment of year end bills shall be transferred into this account, for the purpose of purchasing equipment.  If the Village Board does not put the unused funds from the Fire Departments budget into the NYCLASS FIRE COMP account then the correct percentage of unused money gets returned to the Town.

 

6.      Members of the Village Fire Department, while engaged in the performance of their duties in answering, attending upon or returning from any call provided by this Agreement, shall have the same rights, privileges and immunities as if performing the same within the Village of Lyndonville.

 

7.      This Agreement shall continue for a period of five (5) years commencing June 1, 2015 and terminating May 30, 2020.

RESOLUTION TO ADOPT THE PRELIMINARY BUDGET AS THE TOWN OF YATES FINAL BUDGET FOR 2016

 

WHEREAS, a public hearing on the preliminary for the year 2016 was held on November 12, 2015 at 3:30 P.M. and all person asking to be heard were allowed to speak,

WHEREAS, there are some delinquent water bills and the owners have been notified by certified  mail that November 16th was the last day to pay water bills before they are placed on the taxes.  Be it

RESOLUTION NO.90-11/15

 

RESOLUTION FOR ASSESSOR AGREEMENT BETWEEN RIDGEWAY, SHELBY AND YATES

 

WHEREAS, the following agreement was presented

 

Intermunicipal Agreement For Assessment Services

Between the Towns of Ridgeway, Shelby, and Yates

This Agreement is made this______ day of______________, 2015 by and between the Towns of Ridgeway, Shelby and Yates, municipal corporations of the State of New York, with offices located at 410 West Avenue, Medina, County of Orleans, New York (“Ridgeway”), 4062 Salt Works Road, Medina, Orleans County, New York (“Shelby”), and 8 South Main Street, Lyndonville, Orleans County, New York (“Yates”).

Witnesseth:

WHEREAS, Shelby and Yates desire to contract with the Town of Ridgeway to provide assessment services to each respective Town in accordance with Article 5-G of the General Municipal Law and RPTL sec. 576; and

WHEREAS, it is both desirous and the intent of Ridgeway, Shelby and Yates to enter into this agreement.

WHEREAS, the terms and conditions of this Agreement have been approved by a majority vote of the Town Boards of Ridgeway, Shelby and Yates.

NOW, THEREFORE, in consideration of the foregoing, it is mutually agreed as follows:

1. Shelby and Yates agree to appoint the Town of Ridgeway Assessor to simultaneously serve as the Assessor for Shelby and Yates. The appointment of the Ridgeway Assessor to serve as the Assessor for Shelby and Yates (hereinafter referred to as the “Assessor”) shall be approved by the majority of the Shelby and Yates Town Boards prior to the effective date of this Agreement. Any individual appointment as Assessor by the Town of Ridgeway shall satisfy the minimum qualification standards for Assessors as established by 20NYCRR 8188 (sec. 8188-2.2).

 

2. The Assessor shall be responsible for assessing all parcels of real property located in the Towns of Ridgeway, Shelby, and Yates for the purposes of taxation and special ad valorem levies for town, county, special district and school district purposes and all other duties as required for assessors by the Real Property Tax Law, and the rules of the State Board of Real Property services.

 

 

3. The Assessor shall maintain an office at 410 West Avenue, Medina, New York which will be open to and able to serve all residents in the Towns of Ridgeway, Shelby and Yates. The Assessor or Assessor staff will be present no less than one full work day per week in the Town of Yates office. Said day of the week and hours to be worked shall be established by the Town Board of the Town of Yates at their annual Organizational Meeting. While at the Town of Yates office, the Assessor or Assessor staff shall also be open to and able to serve all the residents of each Town. The three Towns shall afford the Assessor and staff the flexibility to allow the performance of all duties of all Towns at all times.

 

4. The Assessor may perform duties of Ridgeway, Shelby, and Yates regardless of which office they are present in and receive and return telephone calls, emails and other communications from either office. The Assessor shall attend the regular monthly Board meetings of Ridgeway, Shelby and Yates and shall also attend special Town Board meetings as necessary and as requested.

 

5. The Assessor shall, for all purposes, be deemed an employee for the Town of Ridgeway. The Town of Ridgeway shall pay the Assessor’s salary and make employer’s contributions for retirement, social security, health insurance, workers compensation, NYS disability and other benefits. Shelby and Yates agree to share all costs incurred by Ridgeway as employer, including the Assessor’s salary, any Assessor ‘s staff salary, employers share of FICA, health insurance costs, retirement, NYS Disablility and all employee benefits and costs provided by Ridgeway as employer, on a proportionate pro rata basis based on the number of tax map parcels contained within each town. It is agreed that the assessor shall be responsible to and shall report to the Supervisor of each Town as to issues relative to assessments and assessment services in each individual Town respectively.

 

6. Shelby and Yates shall also pay to the Town of Ridgeway their share, on the same proportionate pro rata basis as above-noted in paragraph 5, of the Town of Ridgeway Assessor Department’s yearly budget for the following items: Education, office supplies and postage, and computer services and computer related items. The following items shall not be included in the payments to Ridgeway and will be paid by each individual town :pictometry, legal fees and legal notices, Board of Assessment Review costs, NYS and Orleans County Assessor Association dues and any other professional dues each town deems appropriate and mileage. Said payments from Yates and Shelby shall be made to Ridgeway in quarterly installments, one-quarter by January 15, one-quarter by March 15, one-quarter by July 15, and one-quarter by October 15 of each year. The payments shall be paid to the Chief Fiscal Officer of Ridgeway and billed to each Town by the Ridgeway Town Clerk at least 30 days prior to the due dates herein.

 

 

7. If at the end of the fiscal year there is a balance in the Town of Ridgeway Assessor’s budget, the Chief Fiscal Officer of the Town of Ridgeway shall determine each Party’s share of non-expended funds on the same pro rata basis of the number of parcels contained within each Town as paid. If said overage exists the refund shall be sent to each Town by the Chief Fiscal Officer of the Town of Ridgeway by the end of each fiscal year as and for a refund of all costs and expenses incurred.

 

8. Ridgeway agrees to budget for all training expenses and Shelby and Yates agree to share in the costs, on a pro rata basis on the number of tax map parcels contained in each town as of the latest final assessment roll. Said costs to be included in the quarterly billing statements rendered by Ridgeway in which months the costs were incurred.

 

9. The Chief Fiscal Officer of Ridgeway shall determine on or before September 15th of every year of this Agreement each Town’s share of the costs and expenses for the upcoming year. Ridgeway shall render quarterly statements to Shelby and Yates for the amounts due hereunder pursuant to paragraph 6 of this Agreement. If such quarterly statements are rendered less than 30 days prior to the due date of same, than, in that event, the payment due date shall be the 30 days after the quarterly statement is rendered..

 

10. In cases where the Towns are not in agreement as to the number of tax map parcels contained within each town, the municipalities shall request the County Director of Real Property Tax Services, for purposes of this Agreement, to annually determine the number of tax map parcels contained within each town.

 

11. The terms and conditions of this agreement, including the assessor’s salary and the budget for the operating costs of the assessor’s office, shall be reviewed annually in September by each Town Board during the term of this Agreement. If any Town Board desires to make any amendments and modifications to the terms and provisions of this agreement, a joint session of the Town Boards shall be held at a time agreeable as soon as possible in October.

 

12. This agreement shall be effective as of January 1, 2016 and shall remain in effect for a period of five years except if terminated earlier as provided in paragraph 13.

 

13. Any of the parties may cancel this agreement for any reason with 60 days written notice delivered by first class mail, return receipt requested, to the Town Supervisor of the other Parties. Termination shall be effective no sooner than the 60th day after receipt of such notice, or such other later date as specified in the notice. Ridgeway shall be entitled to all payments for services rendered under this agreement up to the effective date of termination, on a pro-rata basis.

 

14. This agreement shall be amended, modified or terminated only upon approval by a majority vote of the Town Board of each Town in the manner prescribed by law.

RESOLUTION TO AUTHORIZE SUPERVISER TO SIGN  PERSONNEL AGREEMENT WITH ASSESSOR

AGREEMENT, made this _____ day of ____________, 201__, by and between PATRICIA M. LASZEWSKI, of 504 Eagle Street, Medina, New York, and the Towns of Ridgeway, Shelby and Yates, municipal corporations with offices located at 410 West Avenue, Medina, NY, 4062 Salt Works Road and 8 South Main Street, Lyndonville, NY, respectively.

WHEREAS, the Town of Ridgeway has heretofore adopted a Resolution appointing PATRICIA M. LASZEWSKI to the position of the Assessor for the Town of Ridgeway, and

WHEREAS, the Town of Ridgeway has entered into an agreement with the towns of Shelby and Yates to provide assessment services for both Towns whereby the Towns each pay their respective pro-rata costs of the total Town of Ridgeway Assessor's budget (Intermunicipal Assessment Agreement),  and

NOW, THEREFORE, in consideration of the promises and for the other good and valuable consideration, the parties agree as follows:

1.    The Assessor, PATRICIA M. LASZEWSKI, shall provide assessor services as set forth in the Intermunicipal Assessment Agreement, but shall be deemed to be an employee of the Town of Ridgeway and will follow all Work Rules adopted by the Town of Ridgeway dated, July 20, 2015 and any amendments thereafter to same. These Work Rules include but are not limited to, office hours, vacation time, sick time and holidays.

 

2.    The Assessor, PATRICIA M. LASZEWSKI, shall be paid an annual salary of $53,000 beginning 1/1/2016. The Assessor will receive no less than an annual salary increase of 3% in the years, 2017, 2018, and 2019. Salary increases after 2019 will be given as deemed appropriate by the municipalities of this agreement.

 

3.    The Town Board of the Town of Ridgeway shall hire, upon the recommendation of the Town of Ridgeway Assessor,  and be the immediate Supervisor of,  one full-time employee to be trained in the field of assessing. The assessor’s assistant will perform all duties deemed appropriate for their skill level until further training can be obtained through the NYS Office of Real Property Tax Services. The employee shall seek all training available to become a Certified Assessor and must obtain said certification within three years from the date of hire.

 

4.    The Assessor's assistant shall be paid an hourly rate of $13.75 and shall work 32.5 hours per week pursuant to the Town of Ridgeway work rules. They shall be an employee of the Town of Ridgeway, and will be eligible for all benefits included in the Town of Ridgeway Work Rules. Once the employee obtains NYS Assessor Certification, the employee shall become a salaried employee by resolution of the Town Boards. The salaried amount shall be determined by the current, annualized hourly rate to include a one time  salary increase in the amount of  $5000.

 

5.    The Town of Ridgeway’s Assessor’s budget shall be governed by the Terms and Conditions contained within this agreement and those within the previously agreed upon Intermunicipal Agreement for Assessment Services.  Said terms of this Agreement may be modified upon joint sessions of the three towns and upon the majority vote of each Town Board. 

 

6.    This Agreement shall be effective January 1, 2016 and shall remain in effect for a   period of five years except as terminated pursuant to the same terms of paragraph 13 of the Intermunicipal Agreement heretofore previously executed.
