 The regular meeting  was called to Order by the  Deputy Supervisor at 7:00 P.M. at the Town Hall 8 South Main Street, Lyndonville NY

Privilege of the Floor:

 

John Hevron- asked about the Town policy on campers on lots.

Zoning Officer Dan Wolfe stated that there are rules in the zoning that state a camper can have a Special permit and be occupied for 30 days. He will be sending out notices .

 

John Hevron- There are also stakes along property on the right-of-way that could be dangerous.

 

Dan Wolfe- this is a private property matter

 

Slawomir Majorowski- The firelane that we use fills in during the winter storms  because of  bushes that are not trimmed .  We would like the Town trucks to plow this part of our lane when we get large amounts of snow.

 

Roger Wolfe Highway Superintendent stated that these are Private lanes and the Town is not allowed to go on private property..

 

Anna Majorowski-when there is need for medical or fire emergency what happens.

 

Roger Wolfe stated that he would be contacted as to the problem and they then would try and clear the lane in question in a true emergency.

 

Slawomir Majorowski- the lane has been repaired since we built the house we paid $1,200 to do this but we are not able to clear the row of bushes and this fills in with snow 3 or so times a year.

 

Supervisor Martino stated that the Town can meet with the residents on the lane and have the Highway Superintend there and Board members to help sort out the problem.  But this is still a private lane and  we do not plow private lanes.

 

Councilman Bentley stat3ed he knows the problem as he has to go down unplowed lanes to feed cattle. 

 

Supervisor Martino suggested Someone with a rotary snow blower could be hired to clear the lane

 

 

 

 

RESOLUTION NO. 84-10/09

 

RESOLUTION TO ACCEPT THE MINUTES OF September 10,,2009     

 

RESOLVED, to accept the minutes of September,10,2009 as presented to each Board Member.

The Town Board was presented with the Tentative Budget for the Fiscal year January 1, 2010 thru December 31,2010.  The Board reviewed the tentative budget and decided to amend the water charges to represent a $10.00 savings to the taxpayers.  The water Special use tax would drop from $210.00 for parcels with a residence to $200.00 Vacant land would drop from $180 to $170.

 

 

 

RESOLUTION NO.85-10/09

 

RESOLUTION TO CHANGE TENTATIVE BUDGET AND ACCEPT

 

WHEREAS, the Town Board has reviewed the Tentative Budget and has made the following changes :

 

Reduce account 1001.00SW4 from 197975.00 to 193,030.00, This would reduce tax payer water charges by $10.00 per parcel. From $210.00 to $200.00 for improved parcel and from $180.00 to $170.00 for vacant parcels

 

BE IT FURTHER RESOLVED these changes shall be made to the Tentative Budget.

RESOLUTION NO. 86-10/09

 

RESOLUTION TO ACCEPT TENTATIVE BUDGET AS PRELIMINARY BUDGET

 

WHEREAS, the Tentative Budget has been reviewed  and amended 

 

BE IT RESOLVED the Town Board accepts the Tentative Budget as the Preliminary Budget for the Town of Yates for the fiscal Year January 1,2010 thru December 31,2010 with changes ,

 

BE IT FURTHER RESOLVED, a public hearing will be held on November 12 ,2009 on the preliminary Budget

RESOLUTION NO.87-10/09

 

RESOLUTION TO CONTRIBUTE $500.00 to Go-Art(Genessee Orleans Council of the Arts.

 

RESOLVED. To contribute $500.00 to the Go-Art program, this program brings concerts and arts to the Town of Yates

RESOLUTION NO.88-10/09

 

RESOLUTION TO CHANGE RETURN CHECK CHARGES

 

WHEREAS, the bank now charges our accounts $39.50 for returned check instead of $10.00 fee, be it

 

RESOLVED that all returned checks will be charged  what the bank charges us plus a $10.00 fee

RESOLUTION NO. 89-10/09

 

RESOLUTION TO SEND A LETTER OF COMMITMENT FOR COUNTY WIDE CABLE CONTRACT

 

WHEREAS, Brian Napoli, Supervisor of the Town of Ridgeway is trying to have a County-wide Cable Contract, be it

 

RESOLVED, the Town of Yates write a letter of commitment in favor of this project.

RESOLUTION NO. 90-10/09

 

RESOLUTION TO MAKE APPOINT TO ASSESSMENT REVIEW BOARD

 

RESOLVED to re-appoint Michael Ferri to the Assessment Review Board for a term of five years beginning on September 30,2009 and commencing on September 30, 2014

Highway Superintendent Wolfe stated that work is almost done on the Hall Road will be putting down 5/8 inch crusher run next week.

 

Supervisor Martino commended the part-time workers on the job they have done.

 

Deputy Supervisor Belson – Have receive a request from the Bar-Lyn youth football for a donation to pay for referees at home games

 

RESOLUTION NO. 91-10/09

 

RESOLUTION TO GIVE BAR-LYN YOUTH FOOTBAL MONEY FOR REFEREES

 

WHEREAS, the youth program has given to summer youth, baseball, wrestling and basketball, be it

 

RESOLVED, the Town will give $500.00 to the Bar-Lyn youth football program.

Assessor- attended fall conference and have updated my credits for assessor

 

Legislature meeting is on October 27,2009

 

Next months Legislature meeting will be hosted by the Town of Yates
