called the Regular Planning Board Meeting to order at 7:00 pm, at the Town of
Yates, 8 S. Main Street, Lyndonville, NY 14098.

MINUTES:
Chairman Donald Lamay entertained a motion to accept the minutes from the May 3, 2012 meeting.
RESOLUTION NO. 5-07/12
RESOLUTION TO ACCEPT THE MEETING MINUTES FROM THE MAY 3, 2012 MEETING AS PRESENTED TO EACH BOARD MEMBER.
RESOLVED, to accept the meeting minutes from May 3, 2012 as presented to each Board Member.

Votes: 4 Ayes (Lamay, Smith, Daum, Kurz); 0 Nays
Please note that there was no official meeting in June due to the lack of Planning Board Members. Harlan Stauffer was there at that time so a couple of questions were asked regarding the windmill he wants to put up.
The noise level was one of the questions asked. According to Mr. Stauffer 15 to 18 dBA is the max for how high it will be.
It will be strictly used for milking machines and the washing machine.
Gary Daum went over the County Planning Board review of the windmill Mr. Stauffer wants to put up. The County Planning Board did approve it – See Attached
Gary Daum then briefly went over the rest of the County Planning Board meeting.
The regular Planning Board meeting adjourned at 7:30 pm for the Public Hearing.
The Public Hearing was for a Special Use Permit Application submitted by Harlan Stauffer of 1230 Foss Rd., Lyndonville, NY 14098 for a Section # 591.30-591.35 windmill.
Chairman Donald Lamay went over the application and the Short Environmental Assessment Form
The windmill will be in a fenced in pasture area. The blades are fiber glass.
Our Zoning allows 50 dBA’s at peak – Mr. Stauffer’s will only be 15 to 18 tops.
Chairman Donald Lamay again read what the County Planning Board said in regards to the windmill.
Paul Lauricella commented by saying how excited he was about the windmill and hopes to see more go up.
Chairman Donald Lamay asked if there were any questions from the public.
Note: No adverse comments from the public.
Closed Public Hearing.
Reconvene the Regular Planning Board meeting.
There were no other questions or concerns about the windmill.

RESOLVED, to accept Harlan Stauffer’s Special Use Permit for a Section # 591.30-591.35, Windmill.

Round Table – Chairman Donald Lamay mentioned to the Planning Board that the Town Board has put a notice in the paper for a Public Hearing – for our request for Alt. Board Members and the water conservation and water restrictions.
Also a note – unless something comes up, there will be no August Meeting.
