called the Regular Planning Board Meeting to order at 7:00 pm, at the Town of
Yates, 8 S. Main Street, Lyndonville, NY 14098.

MINUTES:
Chairman Donald Lamay entertained a motion to accept the minutes from the February 7, 2013 meeting.
RESOLUTION NO. 4-3/13
RESOLUTION TO ACCEPT THE MEETING MINUTES FROM THE FEBRUARY 7, 2013 MEETING AS PRESENTED TO EACH BOARD MEMBER.
RESOLVED, to accept the meeting minutes from February 7, 2013 as presented to each Board Member.

Chairman Donald Lamay asked Code Enforcement Officer Dan Wolfe the status of Marlin Yoder’s special use permit.
Dan Wolfe – Marlin Yoder has resubmitted to the Zoning Board of Appeals and has asked for a variance. Marlin has also reduced the number of dogs he was going to have.
Chairman Donald Lamay mentioned will hold off on discussion of redemption/recycling centers until further notice and will review open special use permits in September.
Chairman Donald Lamay reviewed Randal Stauffer’s special use permit for a Section 741Home Business Class B to build sheds located at 11469 Lakeshore Rd.
Mr. Stauffer does meet all the setbacks. Chairman Donald Lamay also went over the Short Environmental Assessment form.
Chairman Donald Lamay then went over what the County Planning Board had to say and their recommendations. See attached.
Ralph Smith asked – Is the right of way for the lake front residence on Mr. Stauffer’s property.
Dan Auker replied – On the west side, yes. On the east side the right of way is not on this property.
Chairman Donald Lamay went over the site plan.
Ralph Smith asked there is going to be no retail on site?
Randal Stauffer – Thinking wholesale not retail at this time.

Called Public Hearing to order at 7:30 pm
This public hearing is for Randal Stauffer, for a Section 741 Home Business Class B to build sheds.
Chairman Donald Lamay opened the floor for any comments.
Dan Wolfe said that he received a call from Mr. Barth, a lake front neighbor, saying that he was quite happy that the Stauffer family is moving in and Mr. Barth’s daughter is in favor of the business but has asked that the noise be muffled.
Paul Lauricella is also in favor and thinks that retail would be a good idea.
If no other questions, Ed Urbanik requested to move to accept the special use permit.
Chairman Donald Lamay entertained a motion to accept Randal Stauffer’s special use permit for a Section 741 Home Business B to build sheds.

RESOLVED, to accept Randal Stauffer’s special use permit for a Section 741 Home Business B to build sheds.

Steve Freeman briefly went over the County Planning Board meeting.
Chairman Donald Lamay mentioned he will not be here for the next meeting. If there is nothing for the agenda there may not be a meeting. He or Dawn will let the board know.
